Olympia Landlord-Tenant Lawyer
Landlords have many responsibilities and obligations to their tenants. Unfortunately, there are instances in which these obligations are not met. When such circumstances arise, tenants have rights. As a renter, you have a right to live at peace in your home and have the right to take action against a non-responsive, intrusive, or unfair landlord. Retaining a qualified attorney can help you to ensure that your rights remain protected. Ben Cushman is an Olympia landlord-tenant lawyer who handles such matters. He has been serving our community since 1996 and he is ready to help you. Our office also serves those in Tacoma and elsewhere in the state.
Lawyer assisting Olympia and Tacoma in evictions or matters involving tenant rights
Washington is like other states in that our laws place certain responsibilities upon a landlord. These include the responsibilities to ensure that the home has functioning electricity, plumbing, and heat and is generally safe and healthy to live in. A landlord must also maintain the building and utilities, repair or replace certain items if they break due to no fault of the tenant, repair structural damage or leaks, and generally keep the home clear of insect or rodent infestations not caused by the tenant. This is a not a complete list. There are other obligations which the law places upon a landlord. If a landlord breaches their responsibilities, then a tenant may have a right to reduce rent, dispute an eviction, or seek other remedies.
The eviction process begins when a landlord serves the tenant with a notice to vacate. This may result in an “unlawful detainer” lawsuit. To defend, a tenant must an answer and appear at a hearing where the Judge will hear arguments from both sides. Most tenants try, unsuccessfully, to do this without legal help. Washington law specifically prohibits retaliatory evictions. Therefore, while it is often too late to stop an eviction once an eviction process has begun, with the right help, it may not be, and the chance of being able to stay in your home actually increases the more aggressive you were in maintaining your rights before the eviction process began. Dealing with such matters requires an understanding of the applicable laws and procedures and often requires setting up circumstances well in advance by aggressively protecting your rights from the time you moved in. Hiring an experienced attorney is important, both before and during the eviction process.
