Attorneys helping those in Olympia, Tacoma, and other Washington areas with the uncontested divorce process

In Washington, spouses who agree on all issues may obtain a Divorce through a shortened court process. The spouses can either enter into a separation agreement that gets filed along with the Petition for Divorce (Dissolution), or they can just file a joint Petition that sets out the agreed terms. The Court is then able to enter the Dissolution Decree as soon as the 90-day cooling off period has ended. There are advantages to each of these approaches, so it is important to consult with an attorney to determine which one would work best for you.

Regardless of which option you choose, the process only works if you and your spouse have reached an agreement on all the issues, including: (1) a parenting plan addressing the residential schedule and child custody, (2) child support, (3) the division of marital assets and debts, and (4) the payment of spousal support, (to name the major ones).

It is best for you and your spouse to have separate attorneys, although either of you may choose to represent yourself. If you and your spouse are committed to working through the issues without going to court, you may also want to consider hiring Collaborative Divorce attorneys who are committed to helping you reach an agreement rather than going to Court.

Once you and your spouse have reached an agreement and filed the Petition, the Court will sign the Dissolution Decree after the 90-day cooling period has passed and the case will be concluded. Prior to signing the Final Decree, the Court may decide to hold a brief hearing to make sure that both sides understand the ramifications of the proposed agreement. Retaining experienced counsel can help you to ensure that unnecessary complications do not arise.
